HIPAA Notice of Privacy Practices

This Notice is effective August 6, 2026 and remains in effect until replaced. The current version is always posted at /hipaa.

MindGuyMD, LLC is required by the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations to maintain the privacy of your protected health information (PHI), to provide you with this Notice of our legal duties and privacy practices, to follow the terms currently in effect, and to notify you following a breach of unsecured PHI. MindGuyMD, LLC is also required by New Jersey law to maintain the confidentiality of mental-health records.

The practice uses and discloses PHI for treatment, payment, and healthcare operations — and as required or permitted by law. The specific categories include: treatment of you by the practice and coordination with other providers you identify; payment activities including billing and superbill preparation; healthcare operations such as quality review and business management; disclosures required by law (court order, subpoena, judicial proceeding); public-health activities as authorized by law; reports of suspected abuse, neglect, or domestic violence; FDA-related disclosures regarding adverse events or product tracking; law-enforcement requests under applicable law; disclosures to coroners, medical examiners, and funeral directors; organ- and tissue-donation requests; research with appropriate authorization or waiver; disclosures to avert a serious threat to health or safety; specialized government functions (military, veterans, national security); and workers' compensation as authorized by applicable law.

With respect to your PHI you have the right to: access and inspect your record (the practice may charge a reasonable fee for copies); request an amendment if you believe the record is inaccurate or incomplete; request an accounting of certain disclosures (the practice is not required to account for disclosures made for treatment, payment, or healthcare operations, or for the categories listed above); request a restriction on a use or disclosure (the practice is not required to agree to a restriction it cannot fulfill); request confidential communications at a specific address or by a specific method; receive a paper copy of this Notice on request; and complain to the practice or to the Secretary of Health and Human Services without retaliation. The practice reserves the right to change this Notice and to make the new provisions effective for all PHI it maintains, including PHI created or received before the changes were made. A revised Notice will be posted at /hipaa, and a paper copy is available on request.

Questions, complaints, or requests to exercise any of the rights above should be directed to mindguymd@polsia.app. The practice will not retaliate against anyone for filing a complaint.

If you believe your privacy rights have been violated you may file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. The Office for Civil Rights can be reached at https://www.hhs.gov/hipaa/filing-a-complaint/index.html. Filing a complaint with the practice does not prevent you from filing a complaint with HHS.
